TERMS AND CONDITIONS OF TRADE

1) - Bookings-

 

1)a    A 20% deposit is required to secure a booking for an event. (This excludes film and media).

1)b    A tentative booking will only be held for 5 working days, the deposit must be

received with in this period to secure the booking.

1)c    Tentative bookings not secured by a deposit after this period may be cancelled at M.A.Gs discretion.

1)d    Client requested changes to booking dates will be facilitated at M.A.Gs discretion.

1)e    All bookings and deposits will be confirmed and receipted by M.A.G.

1)f     Where a client is forced to cancel due to unforeseen circumstances M.A.G will do its best to provide an alternative date.

1)g    In making a booking the client acknowledges that they are bound by M.A.Gs

health and safety policy and event management rules.
 
2 - Refunds-
 

2)a    Deposits -         2)a)a   Where the client cancels an event no later than 4 weeks

from a booking M.A.G will refund the full deposit.

                                    2)a)b   Where the client cancels an event less than 4 weeks

from a booking but more than 2 weeks from a booking M.A.G will refund 50% of the deposit.

                                    2)a)c   Where the client cancels an event less than 2 weeks

from an event M.A.G reserves the right to retain the full deposit.                                               

2)a)d   Where the client is force to cancel due to unforeseen circumstances    M.A.G may elect to offer an alternative date which will not incur any further booking charges.

                                    2)a)e   Where M.A.G is forced to cancel an event the full

deposit will be refunded if the client does not wish an alternate date.

2)b    Fees/Charges -           2)b)a   In the event of event cancellation due to adverse

weather M.A.G will refund fees paid in full.

                                    2)b)b   Where the client is removed from the event no refund

will given.

                                    2)b)c   Where the client terminates an event for their own

reasons no refund will be given.

                                    2)b)d   Where an event is cancelled due to unforeseen

circumstances a mutually negotiated refund may be given.

2)c    False Details - 2)c)a   No refund will be given if the client supplies False or

Misleading information.
 
 
 
 
 

3) - Terms of trade -

 

3)a    Deposits may be made by way of cheques, cash, money order, or direct credit into the M.A.G holding account.

3)b    Balances owing must be paid in full 1 week prior to the commencement of an event (Film and Media and Special Corporate Events excluded)

3)c    Cheques as ‘In Full’ payments must be cleared 1 week before the commencement of an event.

3)d    Bookings are not considered as confirmed until cheque has cleared.

3)e    All invoiced accounts incur administration fees.

3)f     All accounts are due 20th of the month post date of issue.

3)g    All late accounts will incur late fees, interest, and additional administration charges.

3)f     All sales are regarded as cash sales.

 
 

4) – Liability -

 

4)a    In making a booking the client acknowledges that they understand that airsoft is a full contact sport.

4)b    In making a booking the client acknowledges that they understand that there are potential injury risks associated with the sport of airsoft.

4)c    In making a booking the client acknowledges that they are engaging in the sport of airsoft at their own risk and of their own accord.

4)d    The Client will be responsible or liable for injury to M.A.G staff or damage to M.A.G property caused by gross neglect, carelessness, deliberate recklessness, or failure to abide to its safety rules by the client.

4)e    M.A.G will not indemnify the client against injury to others or damage to others property if the said injury or damage is a result of the clients personal gross negligence, carelessness, deliberate recklessness, misconduct, or failure to abide by M.A.Gs safety rules.

4)f     The client shall at all times follow M.A.Gs safety rules and directives, failure to do so will result in the client being removed from the event.

4)g    The client shall be liable for the full replacement cost or cost of repair associated to any and all damage or loss caused if the said damage or loss is a result of their gross negligence, misuse, carelessness, deliberate recklessness, misconduct, failure to abide by M.A.Gs safety rules, or is a    deliberate act.

4)h    M.A.G will not indemnify the client against injury to self or damage to own property if the said injury or damage is a result of the clients personal gross negligence, carelessness, deliberate recklessness, misconduct, or failure to abide by M.A.Gs safety rules

 
 

5) – Safety -

 

5)a    Clients must abide by M.A.Gs health and safety policy at all times.

5)b    Clients must follow M.A.Gs safety directives at all times.

5)c    Clients acknowledge that failure to do so may result in serious injury to themselves or others.

5)d    Clients will receive a health and safety briefing prior to each event.

6) – Limitations -

 

6)a    M.A.G reserves the right to terminate any event in the interests of safety.

6)b    All clients must be 18 years of age or over.

6)c    All clients must complete a medical advice form.

6)d    All M.A.G events are an alcohol free event.

6)e    Any client found to be under the influence of alcohol or narcotics will be refused participation.

6)f     All M.A.G fields of play are smoke free, smoking is permitted in approved areas only.

6)g    For groups enquiring about upper level events and training M.A.G may request vetting.

6)h    M.A.G may restrict a clients level of participation if they feel there are safety or health issues.

6)i     M.A.G may in the interests of safety restrict or prevent any clients participation if the client has a current injury that may be aggravated or worsened by their participation.

6)j     Clients must provide accepted proof of age on the day of any event. (refer sales for these)

 
 

7) - Confidentiality-

 

7)a    M.A.G will maintain total confidentiality about all client enquiries, bookings, and events.

7)b    Proof of Identities, other than if required by the Fire Arms Licensing Act, will be destroyed.

7)c    All proof of Identities required by the Fire Arms Licensing Act will be retained in confidence.

7)d    M.A.G regards ALL of its dealings, undertakings, negotiations, and contracts as a matter of extreme confidence.

7)e    Requests for information about clients, other than those made by regulatory bodies, can be made under the provisions of the ‘Public Information Act’.

 
 

8) – Reservation Of Right –

 

8)a      M.A.G reserves the right review and to alter in part or in full any of the terms and conditions listed here in. In the event of such a review the Customer will be advised of any and all such changes.

8)b      Any changes to any terms and conditions will not affect or be enforced upon any contract under service.



9) - Sales-
 

9)a    All sales subject to conditions imposed by the ‘Fire Arms Licensing Act’ will require a copy of accepted valid photo identification.

Being:   a)         Drivers License.
                        b)         Passport.
                        c)         Military Service Identification Card.
                        d)         Current Fire Arms License.

9)b    All sales subject to conditions imposed by the ‘Fire Arms Licensing Act’ will be dispatched via signature and identity proof required courier service and as such require a physical delivery address.

9)c    Sales of airsoft weapons will only be made to the following individuals.

Being:   a)         Not holding a current New Zealand Fire Arms License 18 years

of age and over.

b)                 16 years of age to 18 years of age must hold a current New

                                    Zealand Fire Arms License.

For those in category (b) a copy of your current license must be supplied.

            No sale will be completed to persons not meeting this criteria.

9)d    M.A.G regards the sale of airsoft ammunition, magazines, internal workings, propellant, and enhancements to be subject to the same limitations for sale as it has for the sale of airsoft weapons.

9)e    M.A.G reserves the total right to terminate a sale if the client is unable to supply the required documentation in a timely manner or if it has genuine doubts about the accuracy of the information supplied.

9)f     M.A.G will pass all sales attempted under false pretences directly to the New Zealand Police.

9)g    Third party purchases will not be entertained.

9)h    For specialist overseas purchases the price quoted will be subject to changes in the exchange rate of the New Zealand dollar.

9)j     A 50% deposit is required on all requested importations.

9)k    M.A.G may request address verification, failure to supply this will result in the termination of the purchase.

9)l     Cancellation of a requested import after dispatch from the supplier will result in M.A.G retaining the deposit to defray purchase, modification, and shipping costs.

9)m   Each dispatched delivery is accompanied by a receipt code we ask that you txt or e-mail us the code to confirm receipt of your item.

9)n    M.A.G does not imply or offer any guarantee or warranty in excess, additional to, or outside of the standard manufacturers warranty.

9)o    All warranties for weapons and equipment found to have been modified, altered, enhanced, or disassembled in any way, excluding disassembly that is part of the normal function or operation of the item, are void.

9)p    All warranties for weapons and equipment found to be subject to gross neglect, deliberate miss use, or operation that does not comply with the safety and operating instructions, are void.

9)q    M.A.G will supply a repair and parts replacement service in accordance with the manufacturers warranties at its own facility only. M.A.G does not appoint service agents.

 
 
10) - Client Conduct and Liability for Action-
 

10)a The senior client representative, manager, or supervisor on site at any MAG event will be responsible for the conduct of their fellow clients.

10)b MAG will not tolerate threatening, abusive, or dangerous behaviour, any person acting in such a manner will be removed from the event. No refund will be given in such a case.

10)c Where any such person acting in a threatening, abusive, or dangerous manner refuses to leave the event MAG reserves the right to terminate the event. No refund will be given in such a case.

10)d The client group, company, organisation, or club accepts liability for any MAG property unlawfully removed from any MAG event, venue, or vehicle by their participants.

10)e The client group, company, organisation, or club accepts liability for any and all costs associated with the recovery or replacement of any MAG property unlawfully removed from any MAG event, venue, or vehicle by their participants.

10)f   This includes but is not limited to variations in the New Zealand currency, increases in supplier prices, freight, customs and duty, GST, and agents fees.

10)g MAG will refer all instances of the unlawful removal of MAG property immediately to the New Zealand Police even where the property has been recovered or replaced.

 
 

11) - Consumer Guarantees Act 1993-

 

11)a If the Customer is not a Consumer as defined in the CGA, or the Customer acquires or holds itself out as acquiring the Goods or Services under these Terms of Trade for the purpose of a business, nothing in the CGA will apply to the supply of the Goods or Services.

11)b In the case of any Customer to which the above clause does not apply to, the provisions of the Terms of Trade of Trade including these Terms will only apply to the extent that such provisions do not limit or exclude any provisions of the CGA and will take effect subject to the provisions of the CGA.

11)c Where the Customer has an issue/s they should first contact MAG to seek a remedy to the issues.

11)d Where the issues pertain to the supply of a product a written outline of the issues must be submitted to MAG within 14 days of receipt of the product.

11)    Where the issues pertain to the supply of a service they should be raised as soon as able but in writing no later than 7 days from the date of the service.
